2023

Client charged with domestic violence for allegedly assaulting his son.  Charge dismissed prior to trial.

 

Client indicted on felony charge of gross sexual imposition, facing up to five years in prison and 25 years of registration as a sex offender.  No plea offer from State.  Brown Law Office took over case from prior counsel, and Client found NOT GUILTY after jury trial.

 

Client charged with three counts of vehicular manslaughter after traffic accident involving a fatality.  No plea offer from State.  Client was truck driver who faced loss of livelihood from a conviction.  Brown Law Office tried case to jury, and after a short deliberation, client found NOT GUILTY of all charges.

 

2022

Client indicted with felony charges of Carrying a Concealed Weapon and Improper Handling of a Firearm.  Brown Law Office filed a motion to suppress challenging the length of the traffic stop.  Charges DISMISSED.

 

Client charged with two counts of aggravated menacing for allegedly swerving at two individuals with a car.  At a jury trial, the state called three eyewitnesses to testify, and Brown Law Office successfully challenged their credibility.  After a short deliberation, Client found NOT guilty by jury.

2021

Client charged with Felony Domestic Violence, a felony of the third degree and Unlawful Restraint.  Client was facing three years in prison if convicted.  The State made no plea offer, and the Brown Law Office took the case to trial. Client found NOT GUILTY of all charges.

 

Client charged with two counts of attempted murder, two counts of felonious assault, and one count of domestic violence after allegedly shooting a gun at two people.  All charges were accompanied by three year gun specifications.  Client found NOT GUILTY of all charges after trial.

 

Client charged with domestic violence, no plea offer by State.  After trial by jury, Client found NOT GUILTY.

 

Client charged with OVI after blowing over the legal limit.  Brown Law Office filed a motion to suppress challenging the trooper’s basis to detain client, and the trial court granted the motion to suppress after a hearing.  CASE DISMISSED.

 

Client charged with felony theft for allegedly stealing from an employer.  After a several-year delay in serving the indictment on Client, Brown Law Office filed a motion to dismiss on the basis that Client’s constitutional right to a speedy trial had been violated.  Court of common pleas agreed and granted motion to dismiss.  CASE DISMISSED.

 

Client charged with OVI after blowing over the legal limit.  Brown Law Office filed a motion to suppress challenging the trooper’s basis to expand the traffic stop into an OVI investigation, and the trial court granted the motion to suppress after a hearing.  CASE DISMISSED.

 

2020

Client charged with OVI with a BAC more than twice the legal limit.  Prosecutor’s office made no plea offer, and Brown Law Office set it for jury trial.  On the morning of trial, prosecutor’s office reduced the OVI charge to reckless operation, and Client left the courthouse with a $150 fine.

 

Client charged with OVI and blew over the legal limit.  Brown Law Office filed a motion to suppress and challenged the improper detention of the Client.  The court agreed that there was no constitutional basis to detain the Client, and granted the motion to suppress. CASE DISMISSED.

 

After a traffic stop, Client charged with Weapons Under Disability, a Felony of the Third Degree, and Improper Handling of a Firearm, a Felony of the Fourth Degree.  Arresting officer claimed that Client was driving too slow in violation of Ohio Revised Code 4511.22.  Brown Law Office challenged the stop, and the trial court agreed that the stop was unconstitutional.  CASE DISMISSED.

 

2019

Ninth District Court of Appeals

Client charged with OVI.  Brown Law Office filed Motion to Suppress challenging the officer’s basis to extend the stop, which was denied by the trial court despite the Brown Law Office exposing numerous inconsistencies in the officer’s testimony.  Brown Law Office appealed to Ninth District Court of Appeals, which reversed the trial court’s decision denying the motion to suppress.  CASE DISMISSED.

Wayne County Common Pleas Court

Client charged with Deception to Obtain a Dangerous Drug, a felony of the fourth degree, and Forgery, a felony of the fifth degree.  Client was a health care professional who faced the loss of professional license. Brown Law Office filed Motion to Dismiss, arguing that Client’s constitutional right to a speedy trial had been violated, which trial court granted. CASE DISMISSED.

Wayne County Common Pleas Court

Client charged with Possession of Drugs, a felony of the fifth degree.  Brown Law Office filed Motion to Suppress, arguing that detention of client was unconstitutionally prolonged, which trial court granted.  CASE DISMISSED.

Wayne County Municipal Court

Client charged with Domestic Violence, Assault, and Disorderly Conduct.  After receiving no plea offer from the State, Brown Law Office tried case to jury which found client NOT GUILTY of all charges.

Wayne County Municipal Court

Client charged with OVI.  Brown Law Office filed Motion to Suppress challenging the reasonable suspicion to extend the traffic stop, which was granted by the court.  CASE DISMISSED.

Wayne County Municipal Court

Client charged with OVI, second offense in ten years.  Brown Law Office filed Motion to Suppress challenging the basis for the stop, which was granted by the Court.  CASE DISMISSED.

 

2018

Wayne County Common Pleas Court

Client charged with Felonious Assault with Drive-By Shooting Firearm Specification, Discharge of Firearm On or Near Prohibited Premises, Having Weapons While Under Disability, Improperly Handling Firearms in a Motor Vehicle, and Aggravated Menacing.  Client faced mandatory seven years in prison if convicted, and up to 13 years.  After receiving no plea offer from the State, Brown Law Office tried case to jury which found client NOT GUILTY on all counts.

Wayne County Municipal Court

Client charged with OVI and Falsification.  Brown Law Office filed Motion to Suppress and Motion to Dismiss on Speedy Trial Grounds.  Court dismissed case on speedy trial grounds.

 

2017

Holmes County Municipal Court

Client charged with Aggravated Menacing, a Misdemeanor of the First Degree.  Client found NOT GUILTY after trial.

Wayne County Municipal Court

Client charged with OVI, a misdemeanor of the first degree.  Charge dismissed.

 

2016

Wayne County Common Pleas Court

Client charged with Possession of Heroin, a Felony of the Fifth Degree. At trial, Brown Law Office challenged chain of custody of alleged drugs. Client found NOT GUILTY after Court determined that chain of custody was insufficient.

Client charged with Burglary, a Felony of the Third Degree. After trial to bench, Court determined that State’s witness was not credible and Client was found NOT GUILTY.

Wayne County Municipal Court

Client charged with criminal trespass.  After trial to bench, Client found NOT GUILTY.

Client charged with two counts of domestic violence and one count of assault.  After trial to jury, Client found NOT GUILTY of first degree misdemeanor domestic violence and assault.

Client charged with OVI.  The Brown Law Office challenged the basis for the stop, and the Court held that the arresting officer lacked reasonable suspicion to stop Client’s vehicle.  Case dismissed.

Client charged with possession of marijuana. After Client consulted with other attorneys who told Client there was no way to defend the charge, the Brown Law Office took the case to trial and challenged the chain of custody of the alleged marijuana. Brown Law Office proved that chain of custody was broken, and Client was found NOT GUILTY.

Client charged with menacing for allegedly threatening another individual. After trial to jury, Client found NOT GUILTY of menacing.

2015

Wayne County Municipal Court

Client charged with two counts of assault, and one count of obstructing official business.  Not guilty on all counts after jury trial.

Client charged with possession of marijuana after traffic stop.  Filed motion to suppress on the basis that officer had no basis to search client’s person without reasonable suspicion, which court granted.  Case dismissed.
