The Ohio Ninth District Court of Appeals recently released a decision that could have a major impact on OVI/DUI cases in Wayne, Medina, Lorain, and Summit Counties.  In a unanimous decision, the Ninth District held that blood test results must be suppressed because the State could not establish that the syringe used to draw the OVI suspect’s blood contained a “solid anticoagulant.”  That means that the blood test results could not be used and the State was forced to dismiss the OVI/DUI prosecution.  The link to the decision can be found here.
