The Ninth District Court of Appeals recently issued a decision in an OVI case regarding a trooper’s reasonable suspicion to stop a motorist.  State v. Frederick, 2018-Ohio-1566, involved a situation in which the trooper’s dash cam video failed to clearly establish a basis for the stop.  However, the trooper testified that he witnessed the defendant travel over the fog line, and therefore had a basis to stop him, which led to an OVI investigation.  Frederick continues the Ninth District’s practice of deferring to the trial court’s determinations of credibility.  A link to the decision can be found here.
