Jury Trial or Bench Trial?

An experienced criminal attorney makes a number of tactical decisions when defending your case.  One of the decisions involves whether to try to your criminal case to a jury or to the judge, which is known as a bench trial.  This a decision that you should make in consultation with your criminal attorney, because it can affect the outcome of the trial.

The Sixth Amendment to the United States Constitutions affords all individuals charged with a criminal offense that carries the possibility of jail time the right to a jury trial.  Experienced criminal attorneys have the ability in many cases to persuade juries that there is reasonable doubt as to your guilt, which results in a not guilty verdict.  However, not all criminal cases are tried to a jury.  If the case involves highly technical or legal issues, it may be better to try the case to the judge, where no jury would be involved and the judge would make the final decision.  Your criminal defense attorney should make this decision in consultation with you.
